Nomadic Tribe

1. These Standards set out the terms on which you may make use of the Services, including when you upload content and make contact with other users. Use of our Services includes accessing, browsing, interacting with, or registering to use the Site, App and/or Social Media Platform and installing the App on your device.
2. Our Terms and Conditions and Privacy Policy also apply to your use of our Services.
3. Failure to comply with these Standards, which shall be determined by us in our sole discretion, may result in us taking one or more of the following actions:
   1. Issuing a warning against you;
   2. Restricting your ability to interact with the Services and/or other users of the Services;
   3. Requiring you to remove any Contribution (see below) that is prohibited and suspending your activity on the Services until you have removed the relevant Contribution;
   4. Immediate, temporary or permanent withdrawal of your use of our Services;
   5. Immediate, temporary or permanent removal of any Contribution uploaded by you to our Services;
   6. Initiating legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from your breach of these Standards;
   7. Taking such further legal action against you as we deem necessary; and/or
   8. Disclosing such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

1. You may only use our Services for lawful purposes.
2. You may not use our Services:
   1. In any way that breaches applicable local, national or international laws or regulations.
   2. In any way that is unlawful, or fraudulent, or has any unlawful or fraudulent purposes or effect.
   3. For the purpose of harming or attempting to harm minors in any way.
   4. To bully, threaten, intimidate, insult, harm or humiliate any person.
   5. To send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content Standards (see below).
3. When using our Services, you also agree:
   1. Not to reproduce, duplicate, copy or re-sell any part of our Services in contravention of the provisions of our Terms and Conditions.
   2. Not to access without authority, interfere with, damage or disrupt:
      1. Any part of our Services;
      2. Any equipment or network on which our Services are hosted;
      3. Any software used in the provisions of our Services; or
      4. Any equipment, network or software owned or used by any third party.

1. Our Services may allow for interactive functionality from time to time, including, without limitation:
   1. Direct messaging functionality;
   2. Nomadi Near Me features.

   (“Interactive Services”)

2. Where we do provide any Interactive Service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
3. We will do our best to assess any possible risks for users (and in particular, for minors) from third parties when they use any interactive service provided on our Services, and we will decide in each case whether it is appropriate to provide moderation of the relevant service (including what kind of moderation to provide) in light of those risks. However, we are under no obligation to oversee, monitor or moderate any Interactive Service we provide on our Services, and we expressly exclude our liability for any loss or damage arising from the use of any Interactive Service by a user in contravention of our Content Standards (see below), whether the service is moderated or not.
4. The use of any of our Interactive Services by a minor below the age of 14 is subject to the consent of their parent or guardian. We advise parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online, as moderation is not foolproof. Minors who are using any interactive service should be made aware of the potential risks to them.
5. Where we do moderate an Interactive Service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

1. Any and all material which you contribute to our Services, which includes, without limitation, posts on the Social Media Platform and communications with users through our Services (“Contribution”) shall be subject to the standards set out below (the “Content Standards”).
2. You must comply with the letter, and the spirit of, the Content Standards. The Content Standards apply to each part of any Contribution as well as to its whole.
3. We will determine, in our absolute discretion, whether a Contribution breaches the Content Standards.
4. A Contribution must:
   1. Be accurate (where it states facts).
   2. Be genuinely held (where it states opinions).
   3. Comply with the law applicable in England and Wales and in any country from which it is posted.
5. A Contribution must not:
   1. Be defamatory of any person.
   2. Be obscene, offensive, hateful or inflammatory.
   3. Bully, insult, threaten, intimidate, harm or humiliate.
   4. Promote sexually explicit material.
   5. Contain any intimate, photos, videos or other material of a person without their explicit consent.
   6. Promote violence.
   7. Promote suicide or self-harm.
   8. Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
   9. Infringe any copyright, database right or trade mark of any other person.
   10. Be likely to deceive any person.
   11. Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
   12. Promote any illegal activity.
   13. Be in contempt of court.
   14. Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
   15. Be likely to harass, upset, embarrass, alarm or annoy any other person.
   16. Comprise of unwanted sexual advances towards another user.
   17. Disregard the rights, freedoms and interests of other users of our Services.
   18. Impersonate any person, or misrepresent your identity or affiliation with any person.
   19. Give the impression that the Contribution emanates from Nomadic Tribe LLC, if this is not the case.
   20. Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
   21. Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
   22. Contain any material or information that a member of any tribe that you have visited has requested that you do not make available on our Services.
   23. Contain any advertising or promote any services or web links to other sites or be a form of spam.
6. If your Contributions specifically concern tribes you have visited and people with whom you have interacted, be thoughtful and considerate. Your Contributions must not be exploitative of the people you meet and/or be degrading or disrespectful.

1. If you encounter something when using our Services that you consider may be in breach of any of our terms, please report this to us using the reporting features provided within the app or under moderation@nomadictribe.com. Please use the reporting features within the app wherever possible as these have been provided to expedite any reported breaches and ensure that they can be effectively trace and acted upon.
2. When you report something to us by email, please provide as much information as possible, including links to the material concerned, details of usernames and a description of the material.
3. You may encounter Contributions or other material that you do not like or agree with, but which is not in contravention of any of our terms. In such circumstances, you may block the user responsible for making such material available.
4. We encourage our users to resolve differences between themselves, which is often the quickest way to reach a resolution. If someone has made a Contribution which includes your details or information, try contacting them directly and requesting that they remove the material at issue.
